
IMVU "Branded Content" Proposal
This is a proposal to offer the service of, "Creating branded content", for use in IMVU,This is an open proposal, being actively constructed.

There are many elements presented within this document that are protected as, "Intellectual Property" (IP), related to "Asset Creation", by and of "Jason A. D'Angelo", (AKA: ISAWHIM). Methods of operation, flow of operation, images, text, and structure, are all elements that will be subject to protection.
Until further notice, these stated elements contained within, which are original, will hold these limitations of use and reproduction. Limitations are subject to change without notice, and may require further written release permission to continue use without penalty. Due to the nature of the contents and methods being incomplete, there are additional rights that may have further protections covered by this set of limitations, with additional protections and limitations that have not been expressed here.

IMPORTANT NOTICE ABOUT IMVU:
This document is not directly associated with "IMVU Inc.", and is a separate project by the artists, for the artists. The only direct association with IMVU, at this time, is the use of the created content, and associated IMVU credits, with respect to the potential trademarks and copyrights of created content, related to the desired companies.
Translation: "IMVU Inc.", is not creating this project. "IMVU Inc.", is not responsible for the statements, suggestions, ideas, enforcement, and/or any legal issues associated with this project. IMVU is only a tool used to create the content, which has separate rules and limitations that must be followed separately. These rules of IMVU include, but are not limited to, "TOS", "Purchase of credits", "Sale of credits", "Developer rights", "Exchange of credits", "Sale of created IMVU content", and, "Fees for developing". Those elements are to be separately considered as, "Functions of IMVU", not considered as, "Part of this programs functions, rules, or protections." Additionally, other participating companies may/will have similar rules and limitations, which must be followed, but must not be considered as, "Part of this programs functions, rules, or protections."

LIMITATIONS FOR RIGHTS OF USE:
The limitations of use, at this moment, are due in part to incompleteness which, if used as is, could lead to undesired operation that would harm the participants, resulting in a loss of fair rights or due credits. I/We, will not participate in the improper use of this information, where it is clear or suggested, that there is personal gain, loss of rights, and/or failure to deliver all due credits, to those who participate, at any level. This includes participation from "IMVU Inc.", "IMVU Developers", "Branding Owners", and/or, "IMVU Customers".
Failure to respect these rights, may/will result in prosecution. Everyone has the right to file a, "Class Action Lawsuit", if there is a failure to provide the stated services, or if there is a direct violation of abuse through the use of this information contained within these documents.
These documents have portions that are purposely removed, to help offer protection form suggestive abuse, or to offer protection from public exposure to private agreements between the respective parties, from the parties that are not respectively within those agreements.
Translation: This project is not complete, at this moment. You would not jump into a car that is not finished being built, and attempt to drive it, would you? You would put others at risk, or in harms way, by trying to drive that car on a public road. On that same respect, it would not be wise to fill that same car with passengers.
Additionally, if you attempt to slap our logo on the front of your car, and it does crash, you will face additional repercussions, since you have been warned that I/We have not released this incomplete manufactured car, you just stole it.
Finally, the portions that are removed/protected, can be thought of this way. You don't care how your toilet water gets turned into drinking water after you flush your toilet. You just know that it does, and expect it to be safe to drink after it is processed. You will have disclosure that clearly states, "This water is safe for drinking."

OVERVIEW OF PROJECT DESIRES:
To provide a unified, unbiased, open-participation, collaboration. This collaboration will be offered as a service to branded content owners, using IMVU as the display and delivery of content to the users of IMVU. Additionally offering direct and indirect services to IMVU, through mutual cross-branding and advertisement purchase.
This service will depend mostly on the use of existing tools and methods within IMVU. This unique method will offer recognition, reward, and exposure for all participants. These services avoid the normal expected costs or limitations associated with this type of service, if they were to be conducted through traditional or independent methods.

HOW IMVU CREDITS WORK:
IMVU.com is a website that hosts a 3D instant messaging chat program and a, "Social Networking", homepage arrangement, available for free, to the entire world public. Portions of the IMVU 3D world include the ability to customize your 3D character and the 3D rooms that you use to chat. Additionally, you have the ability to add 2D content to your homepage. Some things can be purchased with the free promotional credits or require you to purchase/earn paid credits.
IMVU uses a credit system, with three types of credits. Paid credits have the greatest level of freedom in IMVU. Dev-Tokens are offered as a reward to the content creators, when content is purchased with promotional credits. Promotional credits are offered as promotions to users, to encourage joining and give users a taste of what the paid credits can be used for.
For the most part, credits are used to purchase virtual goods within IMVU. These goods are seemingly unlimited in possible function and creation variation, thanks to IMVU's content creation system. Developers who create content, can sell the items from the self-arranged IMVU catalog of items. Rewards to developers come from a portion of paid credits, and where paid credits are not available, reward of a Dev-Token is offered. Additionally, IMVU is constantly adding features and alternate ways to exchange credits for goods and services.
Dev-tokens have a limited, "Service only", use in IMVU. the developers of content can purchase further promotion for their creations, in the form of a, "Shout-Out", which is broadcast to the IMVU community users throughout all portions of the IMVU service. The Dev-tokens can also be used to pay for the content creation process, which is an additional reward for those creating content that has been purchased by promo credits.
Promo credits have the greatest limitations, for reasons of developer concern, related to the abuse of these free offerings. Promo credits can not be given to another user, used to purchase a gift for another user, or used to purchase services within IMVU. This limited regulation helps to reduce abuse of this free gift to the users, from IMVU. Further limitations help to reduce the explosion of unwanted promo credits in circulation, to help keep developers interested in contributing to the content creation for IMVU.
NOTE: There are many debatable issues surrounding the regulations, of which there is little resolution that is possible, at the moment. This project hopes to encourage the continued development and offerings, while simultaneously trying to discourage the abuse where there is no ability to offer control, and offer a more rewarding and valued payment, for all who add content to the IMVU 3D chat. Having stability in rewards and additional fairness in participation in the creation, is the base for this projects operations.

EXPLANATION OF THE SITUATION:
Branded content is a scarce item in IMVU. Where content does exist, there are possible violations of the law which limit similarity or force those items to be removed after review. The violating creator gains unfair volumes of credits and sales, which can be cashed-in before the items have been removed, resulting in the loss of that creators account.
NOTE: There is a system in place that assists the reporting of these violations, and a specific method for removal, as required by law.

THE GENERAL PROBLEM:
These violating items absorb credits from customers, when the credits could have been used to fund further development of non-violating creations. Customers who purchase the violating content feel cheated after it is removed, and the artists who lost those potential sales feel cheated, because the customer can not purchase other items with the lost credits. Creators in violation risk the loss of their developer rights and can no longer create additional content in IMVU. The credits that have been cashed-in, are used to fund the creation of a new account, leading to further abuse.
NOTE: These are general opinions that have been gathered from users comments in the IMVU community forums, or expressed as concerns through direct contact. This abuse is due to the limitations of the Internet, programming, or methods. (IMVU continues to offer control, where control is possible.)

WHAT CREATED THE PROBLEM:
The greatest contributing factor in the creation of the problem is the users desire for branded content. Legal creation of these items is limited by the high costs associated with purchasing rights to create this desired content. Failure to understand the laws that regulate this type of content are another factor related to innocent abuse. While the inability to screen and research for all possible violations, contributes to known and direct violations.
NOTE: There is no single contributing element that leads to the creation of the problem. Many compounded and separate situations lead to this abuse. (There may be more situations that contribute to this situation. These are the ones most obvious and prominantly observed.)

DESIRED GOALS:
This program has many purposes. Each purpose detailed below, may have gains that are direct and indirect. Direct gains are ones that are apparent and have an explicit and direct purpose. Indirect gains are ones that may not be as apparent or may not have an explicit direct purpose. All gains, where mentioned, should be seen as potential possibility and not an implicit guarantee.
OFFERINGS:
1. To bring "Branded Content" to IMVU, legally, for purchase by the users.
2. To offer "Branded Content" owners, a unique and desired form of content.
3. To offer "Branded Content" owners, a viable and cost effective service.
4. To offer "Branded Content" owners, quick and efficient content creation ability.
5. To offer "Branded Content" owners, completion in delivered content.
6. To offer "Branded Content" owners, cross-branding advertisement.
7. To offer IMVU, desired content to encourage the purchase of credits.
8. To offer IMVU, exposure for future services for "Branded Content" owners.
9. To offer Developers, an alternative to the existing competitive creation method.
10. To offer Developers, an alternative to the existing independent earnings method.
11. To offer Developers, true recognition for creation efforts.
12. To offer Developers, a steady flow of IMVU credits for creation efforts.
13. To offer Developers, fair and equal opportunity to participate in this project.
14. To offer Developers, more ability to have earned credits exchanged into currency.
15. To offer Users, more incentive to participate, use, and stay, longer in IMVU.

HOW TO GET BRANDED CONTENT INTO IMVU:

The usual way to get branded content into IMVU, would be to purchase rights to use the branded content. Branded content may have copyrights, trademarks, patents, and design patents. Even if we could afford to pay for the rights, there is a good chance that we would still be denied the right to use them.
Branding is not like a classic item that you would normally think of, when it comes to the purchase of rights. The branding owners have a public image to uphold, even in private establishments. It is not normal to surrender rights to individuals, or other companies. They paid for the rights to own the associated branding, for protection from abuse, not to encourage it by selling to independent creators.
There is a unique alternative. Classically, the branding owners would hire a team of developers to create content under the branding name. Time has shown this classic method to be a poor return on investment. IMVU knows this too. IMVU would not be where it is today, if we had to wait for a hand-full of developers to roll-out all the content. They would be broke from paying for all the content to be created. The catalog would only have a few thousand items in a two year period.
What is needed, is a large group of creators, that can quickly complete several thousands of items, in a short time. IMVU has given us the tools for displaying and selling, and many of us have the tools for creating. Branding content owners have the items that need to be created. They do not have the funds to finance a team as large as ours, but they can give us a fair payment for the services we can offer.
Just as we have created content for IMVU, now we will have the option of creating content for "Brand Name Owners", for use in IMVU. They keep the ownership of the brand and only allow acceptable creations to represent their brand. We get the associated credit portion from the sales as direct payment for assisting in the creation of the entire line of branded items. We also get additional payment through bonus incentives.
This is how we will get "Branded Content" into IMVU.

HOW TO HANDLE CREATION OF BRANDED CONTENT:

NOTE: The process flow between "DEVELOPER" and "IMVU CATALOG", represented in this chart is subject to protection as being, (Intellectual Property) related to (Asset Creation) entailed below.
CREATION:
(A) Branding sets job requests for MESH.
(B) Developer takes job request for MESH or STYLE.
(C) Developers submit item for review by the branding company.
(D) Branding company accepts item created.
(E) Branding increments the developers "Credit Division".
(F-I) Branding submits MESH into the catalog and creates STYLE jobs.
(F-II) Branding submits STYLE into the catalog for sale.
SALES:
(G) Customer views catalog item.
(H) Customer purchases item with credits.
(I) IMVU removes credits from customer possession.
(J) IMVU gives customer rights to use the purchased item.
(K) IMVU gives the available credits to the branding co.
(L) Branding co. updates "Credit Division", and deposits credits into the "Credit Pool".
WITHDRAWAL:
(M) Developer extracts the portion desired, with respect to the "Credit Divisions" held, and the "Pooled Credits" related to that developers portion of credits.
The flow from, "Branding Co. Acct.", to, "IMVU Catalog", to, "Customer Acct.", is represented to show that this process uses the existing methods of IMVU. It is only the flow from the, "Developer Acct.", to, "Branding Co. Acct.", which is new in creation and has the inclusion of the, "Credit Pool". Though the process may seem to be a little complex, it is rather simple by design. There are three main portions related to separation within this new creation.
The first section is for the branding owners. They create the job-requests, which may be 3D mesh requests, or style/color requests for existing 3D meshes. Each job has a floating or set "Credit Division". The credit division value is determined by the difficulty of the job-request. Floating values start at 1 and slowly raise, until the limit is reached, or the job is selected by a developer. Once a job-request is, "Submitted or Surrendered", it can be examined or reinserted into the list. Completed meshes, result in the release of the pending styles/colors that are associated with the mesh.
The second section is for the developers. They select job-requests, create the desired item and, "Submit or Surrender", the item back to the branding account. If the item is submitted and has been accepted, it goes directly into the catalog, and the artist is credited with the, "Credit Division", that was associated with that creation. Rejection after submitting, allows for one more chance to fix the item, which must be resubmitted again, or surrendered back to the job-list.
The third section is for the accounts control. This relates to the storage of credits, the data related to credit divisions, and the extraction of credits. Profit will be controlled by the owners of the content, and they must maintain a desirable average sales profit that encourages participation. Every week, the offerings from profit get transferred to the pool account, and are available for delivery to the artists. Each branding owner will have separate offerings, contributing as a whole.
Each separate branding company, will be in competition with the other, trying to earn the desire to have the job-requests filled. The company offering the higher average or greater credit divisions per item, will, naturally, be worked first. They have to gain desire by raising the offering for each creation. There are three ways to raise the offering. Control prices so that the result is a greater profit for the offering, add credits to the pool by purchasing them from the artists or IMVU, and lastly, they can raise the credit divisions associated with creating the item.
Your weekly payments for the items you created will be subject to the offering at the current time. Your participation in further creation, will also be subject to the offering at the current time. At some point in time, the offering may fall below the point of desire to participate or there may not be any more items to create. Your weekly payments will continue to come, as long as the items are still selling in the catalog.
One of the checks and balances here is the competition between companies, to earn your desire to create. Another checks an balances method is the agreement that the company will not be allowed to sell items in the catalog, without the sales being part of the pool. This will allow them to create items of their own free will, or to select individuals to hand projects to. These selected individuals must be a participant of this project, and the company must still offer 9/10 to the other participants.
Having a smaller group of select creators, or providing their own creators, most-likely for the mesh creation, will allow them to arrange a more structured and efficient creation offering. This also ensures that they will not be shorting the artists, by handing-out credit/sales from under us. In fairness, it is our complete ability, as a group, that will ensure they have a wide variety of items to offer, and that will not be allowed to be unfairly rewarded by branching into an independent creation method.
This is how creation of, Branded Content", will be handled.

HOW TO HANDLE CREDITS PAYMENT:
You accumulate, "Credit Divisions", for every item you create. Each item will have a credit division value, listed with the job-request. This value is related to the difficulty or importance of the items desire to be completed. Once a job-request has been selected, that listed value is what you will add to your credit divisions for that company.
Each company will have separate estimations which relate to the credit value that is associated with those credit divisions. Most items will be, or start at one credit division. The credit division may rise, if no-one is taking the job-request. This works almost like a job-bid. If you do not find the credit division to be worth the work, another person may come take that job-request, finding it worth the value.
Every week, the companies submit the offerings to the, "Credit Pool", from the profit they accumulated from IMVU item sales. They also deposit credits related to the offering from referral sales, where applicable. Lastly, they can seed the pool with additional IMVU credits, purchased to promote further participation, by raising their credit division value.
Full financial disclosure, to these transactions, will be available for comparison. You can use this simple information to help determine which, "Branding Company", you would like to create for. Those companies who offer the least, or have difficult items to create, will be noticeable through these numbers.
The over-all, "Credit Pool", will have the same numbers available, as a baseline for you to compare with. The entire work as a whole will let you know who is offering more than average, or less than average offerings. This is a business, after all, and it is not wise to spend hours creating, for the ones who are not offering you the best return on YOUR investment.
Things included in the financial disclosure will be...
Total Items: The total number of IMVU items sold by this company.
Total Item Profit: The total number of credits offered to the, "Credit Pool", related to the profit from the total unit sales.
Bonus Credits: The total number of credits offered to the, "Credit Pool", related to the referral bonuses from, "Real World", items being sold.
Incentive Credits: The total number of credits offered to the, "Credit Pool", purchased from IMVU or the artists, to raise the ACDV.
CDV: The individual credit division value of one credit division, in relation to the total credits deposited into the, "Credit Pool", by this company.
TCD: Total credit divisions this company has created and paid for item creation.
ACD: The average credit divisions, compared to, "Total Items".
ACDV: The average credit divisions value, reflecting the value of the ACD times the CDV.
NOTE: It is safe to assume that the credit divisions you have earned, will continue to hold a high value, as long as there are items to be created. Once the company decides to stop offering job-requests. You can expect that the credit divisions will continue to stay as high as possible and as steady as possible, while the company continues to promote itself.
Your weekly earnings from the credits will continue to come, as long as the company continues to deposit credits into the, "Credit Pool", and as long as you have not violated any IMVU rules, which would lead to the loss of your developer rights. (Part of your developer rights, is the right to collect credits for your creations. Loosing your developer account, is also a loss of the ability to earn credits from the, "Credit Pool".)
Your credits will be deposited to your account, from the, "Credit Pool". There will be an initial delay of a week, after acceptance for any item created. This week is to allow the item to be injected into the catalog, and to allow the companies to have rationed deposit times. Deposit times will be rationed, to reduce the stress on IMVU, related to this service.
NOTE: For example, you can have credits due from 6 companies. Monday, company #1 deposits their weeks credits, Tuesday, company #2 deposits their weeks credits. By Sunday, all the payments are in, and you now get your weeks credits from all companies at once, from the, "Credit Pool". Otherwise, there would be thousands of transactions, as each company sent their payments to each developer.
Any delays related to IMVU's credit delivery service, will not result in a loss of credits. Delays are just delays. Your credit divisions are a steady value. Having two weeks of payments stacked in the pool, due to a technical glitch, will result in the same amount of credits deposited into your account, as two separate weeks would have given you. To further ensure this equality, records will be kept showing PAID CREDITS and DUE CREDITS.
At no point in time, will you be offered, "Cash", or, "Money", for your creations. You must use one of the many IMVU credit brokers to exchange your credits for currency, or sell them on your own. If you are confronted with an outside job with one of these companies, unrelated to IMVU or this service, that will be a separate service, and not a reflection of the activities of this offering. (Failure to receive payment for work unrelated to this process, will not be paid by this process. This process will not be used for payment of unrelated, independent contract work.)
